Express shipping is available at checkout and delivers within 2 to 3 business days. Custom orders require 3 to 5 business days of production time before shipping. Items must be unworn, unwashed, and in their original packaging with all tags attached. Custom-designed items are non-returnable and non-refundable unless the product is defective or contains a manufacturing error on our part. All content, features, and functionality of the Services, including but not limited to the TEESKULL brand name, logo, trademarks, the customizer tool, website design, text, graphics, images, icons, software, and code, are the exclusive property of TEESKULL and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our materials without our prior written consent.
You agree not to use the Services to upload, create, or distribute designs or content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You may not submit designs that promote hate speech, discrimination, or violence against any individual or group. You may not submit designs that infringe upon the trademarks, copyrights, or other intellectual property rights of third parties, including counterfeit brand logos or unauthorized reproductions of protected artwork. You may not attempt to hack, disrupt, manipulate, or gain unauthorized access to any part of the Services, its servers, or any connected databases or systems. Violation of these prohibitions may result in immediate termination of your account and may be reported to the appropriate authorities.
To the maximum extent permitted by applicable law, TEESKULL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, or loss of goodwill, arising out of or in connection with your use of or inability to use the Services, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages. In no event shall our total aggregate liability exceed the total amount paid by you to TEESKULL for the specific order giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the liability.
You agree to indemnify, defend, and hold harmless TEESKULL, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with your use of the Services, your violation of these Terms & Conditions, your violation of any rights of a third party, or any content or design you submit, upload, or distribute through the Services.
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms & Conditions or the breach thereof shall be resolved exclusively in the state or federal courts located in Los Angeles, California. You consent to the personal jurisdiction of such courts and waive any objection to venue.
